Family and Medical Leave ActThe Family and Medical Leave Act (FMLA) is temporarily expanding to help employees during the COVID-19 pandemic. FMLA will now provide job-protected leave for employees who are unable to work, including tele-work, due to the need to care for a child whose school or place of care is closed or unavailable.
Employees who have been employed for at least 30 calendar days are eligible to take up to 12 weeks of leave.
The first two weeks are unpaid, unless other paid leave options are used.
For the remaining leave, employees receive 2/3 of their usual wages with a daily cap of $200 and a maximum benefit of $10,000.
This leave is included in, not in addition to, the limit of 12 weeks of leave in a 12-month period under traditional FMLA guidelines and is only available until December 31, 2020.
